PHOTOGRAPHY LESSONS FOR KIDS - TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern the photography lessons for children provided by PeakLight Chronicles, operated by Eastward Services Limited (Business Registration No. 79533808) ("we," "us," or "our").

By registering for our photography classes, the parent or legal guardian ("you" or "Parent") agrees to these Terms on behalf of the enrolled child ("Student").

 1. SERVICES PROVIDED

 

1.1 Class Structure

We offer group photography lessons for children in outdoor public spaces. Classes are limited to a maximum of 5 students per session to ensure quality instruction and adequate supervision.

 

1.2 Class Schedule

- Classes run daily on weekdays from 3:30 PM to 5:00 PM

- Classes are held in the Tseung Kwan O area

- Pick-up and drop-off location: In front of French International School (LFI), Tseung Kwan O

- Students typically select their weekly time slot upon package purchase, but schedule changes may be accommodated upon request

 

1.3 Age Requirements

Students must be at least 6 years old to participate in our classes.

 

1.4 Supervision

Parents are not required to stay during classes. Students will be supervised by the instructor during the scheduled lesson time. However, parents remain ultimately responsible for their child's behavior and safety at all times.

 2. TRIAL CLASSES

 

2.1 Free Trial

We offer one free trial class per student. Trial classes are informal sessions to allow the child to experience our teaching style and determine interest.

 

2.2 Trial Registration

Parents must register for trial classes in advance and provide emergency contact information prior to attendance.

 

2.3 Trial Limitation

Each student is limited to one free trial class. After the trial, students must purchase a lesson package to continue attending classes.

 3. LESSON PACKAGES AND PRICING

 

3.1 Package Options

We offer two pre-purchased lesson packages:

- 4-class package

- 8-class package

 

Pricing is displayed on our website at www.peaklightchronicles.com

 

3.2 Payment Terms

- Payment must be made in full before attending any classes (excluding free trial)

- Payment is processed through our website

- Currently, we accept card payments via our online payment system

- Additional payment methods may be offered in the future

 

3.3 Package Validity

Lesson packages must be used within 3 months from the date of purchase, assuming weekly attendance (except for anticipated absences communicated in advance).

 4. CANCELLATIONS AND RESCHEDULING

 

4.1 Cancellation by Parent/Student

24+ Hours Notice:

- Students who cancel with at least 24 hours' notice may reschedule their class to another available session

- Cancellations must be submitted via email to peaklightchronicles@gmail.com or WhatsApp to +852 98007031

Less than 24 Hours Notice:

- Cancellations with less than 24 hours' notice will result in the class being counted as used from the package

- Exception: Emergency situations (illness, family emergency) will be accommodated at our discretion

No-Shows:

- Students who do not attend a scheduled class without prior notice will have that class counted as used from their package

- Exception: Valid reasons provided afterward (such as emergencies) may be accommodated at our discretion

 

4.2 Cancellation Due to Weather

 

Classes will be automatically suspended in the following conditions:

- Amber, Red, or Black Rainstorm Warning Signal is in effect

- Typhoon Signal No. 8 or above is in effect

Unstable Weather:

- If weather conditions are uncertain but no official warnings are in effect, parents have the final decision whether to attend

- We will accommodate rescheduling for students who choose not to attend due to weather concerns

Weather Cancellation Protocol:

- Weather-related cancellations will be communicated as soon as possible

- Timing depends on Hong Kong Observatory announcements; no hard commitment on advance notice

- Classes cancelled due to weather will be automatically rescheduled

- Cancelled classes will not count as used from the package

 

4.3 Cancellation by Instructor

If we need to cancel a class for personal reasons (illness, emergency):

- Students will be offered a makeup class

- The cancelled class will not count as used from the package

- We will provide as much advance notice as possible

 

4.4 Schedule Changes

Students may request to change their weekly time slot mid-package. Such changes are subject to availability and our approval.

 5. REFUND POLICY

 

5.1 General Policy

Lesson packages are generally non-refundable once purchased.

 

5.2 Medical Exception

Refunds for unused classes may be considered for medical reasons that prevent the student from continuing classes. Such refunds are at our sole discretion and may require medical documentation.

 

5.3 Behavioral Termination

If we terminate a student's package due to behavioral issues (see Section 8), we will provide a refund for unused classes at our discretion.

 

5.4 No Partial Refunds

Students who choose to discontinue classes for reasons other than those specified above will not receive refunds for unused classes.

 6. EQUIPMENT

 

6.1 Camera Provision

We provide mirrorless cameras for students to use during classes. Students are welcome to bring their own cameras if they prefer.

 

6.2 Equipment Damage

- Students are expected to handle all equipment with reasonable care

- In case of equipment damage or breakage under reasonable circumstances (such as an accidental drop), parents will be charged a flat fee of HKD 2,000 for damage and repairs

- Intentional damage or gross negligence may result in higher charges based on actual repair/replacement costs

 

6.3 Equipment Loss

Parents are responsible for the full replacement cost of any equipment that is lost while in the student's care.

 

6.4 Required Items

Students should bring:

- Water bottle

- Small snack

- Sunscreen (recommended for sun protection)

 7. SAFETY AND SUPERVISION

 

7.1 Safety Rules

Students must adhere to the following safety rules:

- Remain within the instructor's line of sight at all times

- Stay in the designated area and not wander off

- Follow all instructions given by the instructor

- Behave responsibly and safely with photography equipment

- Not engage in dangerous behavior that could harm themselves or others

 

7.2 Emergency Contact Information

 

Parents must provide:

- Current phone numbers (primary and backup)

- Emergency contact information

- Any relevant medical conditions, allergies, or special needs

- Any medications the student takes

 

This information must be provided before the first class (including trial classes).

 

7.3 Injury Protocol

- Parents will be contacted immediately in case of any injury (minor or serious)

- We carry a basic first aid kit for minor injuries

- For serious injuries, emergency services (999) will be called immediately

- We do not have professional first aid certification; our duty is to provide reasonable care and contact emergency services when necessary

 

7.4 Scope of Supervision

- We provide photography instruction and reasonable supervision during class hours

- Parents remain ultimately responsible for their child's behavior and safety

- If a student leaves the designated area or does not follow instructions despite repeated warnings, we will contact parents immediately but are not liable for the student's actions

 8. BEHAVIOR AND CONDUCT

 

8.1 Expected Behavior

Students are expected to:

- Treat the instructor and other students with respect

- Follow instructions and class rules

- Handle equipment carefully

- Participate positively in class activities

 

8.2 Disruptive Behavior

If a student behaves disruptively during a class:

- The student will be allowed to finish that class session

- We reserve the right to terminate the student's package for serious or repeated misbehavior

- If we terminate a package due to behavioral issues, parents will receive a refund for unused classes at our discretion

 

8.3 Dangerous Behavior

Behavior that endangers the student, other students, or the instructor may result in:

- Immediate contact with parents

- Removal from that day's class

- Termination of the package without refund in extreme cases

 9. PHOTOGRAPHY AND MEDIA USAGE

 

9.1 Instructor Photography of Students

We may take photographs of students during classes for the purpose of:

- Sharing progress and class activities with parents

- Teaching feedback and documentation

 

9.2 Marketing and Promotional Use - Separate Consent Required

Use of student photographs or videos on our website, social media (Instagram, Facebook, etc.), or other marketing materials requires separate, explicit written consent from parents.

 

This consent is NOT automatically granted by agreeing to these Terms and Conditions.

Parents will be asked to provide specific consent for marketing use through a separate consent form. Parents may:

- Consent to their child being photographed for marketing purposes

- Decline consent while still participating in all classes

- Withdraw consent at any time by notifying us in writing

 

9.3 Student-Created Photographs

- We retain rights to photographs taken by students during class sessions

- We may use student-created photographs for marketing and promotional purposes

- Student-created photographs will not be used for marketing if they portray other identifiable students (unless separate consent has been obtained from those students' parents)

- Students and parents may request copies of photos taken by the student during classes

 

9.4 Privacy Protection

We are committed to protecting student privacy in accordance with Hong Kong's Personal Data (Privacy) Ordinance. We will:

- Store photographs and student information securely

- Not share student information with third parties without consent

- Respond to parent requests regarding their child's photographs and data

 10. HEALTH AND SAFETY

 

10.1 Medical Information

Parents must inform us of:

- Any medical conditions that may affect the student's participation

- Allergies (food, environmental, medication)

- Any medications the student takes

- Any physical limitations or special needs

 

10.2 Illness

- Students who are visibly ill should not attend class

- If a student becomes ill during class, parents will be contacted for immediate pickup

- Classes missed due to illness may be rescheduled with appropriate notice (see Section 4)

 

10.3 Sun and Weather Protection

- Classes are held outdoors; students should dress appropriately for weather

- Parents should ensure students apply sunscreen before class

- Students should bring water and stay hydrated

- We reserve the right to cancel or postpone classes in extreme heat or other unsafe conditions

 11. LIABILITY AND INDEMNIFICATION

 

11.1 Assumption of Risk

Parents acknowledge that:

- Photography classes involve outdoor activities that carry inherent risks

- Students will be using camera equipment that requires care and attention

- Classes take place in public spaces where we cannot control all environmental factors

- Despite our supervision, accidents and injuries can occur

 

11.2 Limitation of Liability

To the maximum extent permitted by Hong Kong law:

- We are not liable for injuries sustained during classes except in cases of our gross negligence or willful misconduct

- We are not liable for loss or damage to personal belongings brought to class

- We are not responsible for student behavior outside of our direct supervision

- Our total liability for any claim shall not exceed the amount paid for the lesson package

 

11.3 Indemnification

Parents agree to indemnify and hold us harmless from:

- Claims arising from their child's behavior or actions

- Damage caused by their child to property or other persons

- Any breach of these Terms and Conditions

 

11.4 Insurance

We recommend that parents ensure their child has appropriate personal accident and medical insurance coverage.

 12. INTELLECTUAL PROPERTY

 

12.1 Class Materials

All teaching materials, lesson plans, and instructional content remain our intellectual property and may not be reproduced or distributed without our permission.

 

12.2 Student Work

While students retain creative credit for photographs they take, we reserve the right to use student work for educational and promotional purposes as outlined in Section 9.

 13. COMMUNICATION

 

13.1 Primary Communication Method

All official communications will be sent via email to the address provided during registration.

 

13.2 Cancellations and Schedule Changes

Parents may submit cancellations and schedule change requests via:

13.3 Class Reminders

We do not send automatic class reminders. Parents are responsible for tracking their child's class schedule.

 

13.4 Updates and Changes

Important updates (weather cancellations, schedule changes, policy updates) will be communicated via email and/or WhatsApp.

 14. PRIVACY AND DATA PROTECTION

 

14.1 Information Collection

We collect and store:

- Parent and student names

- Contact information (phone, email, address)

- Emergency contact details

- Medical information relevant to class participation

- Payment information (processed securely through our payment provider)

- Photographs and videos as described in Section 9

 

14.2 Data Usage

Personal information is used solely for:

- Class administration and communication

- Emergency contact purposes

- Payment processing

- Marketing (only with explicit consent)

 

14.3 Data Security

We implement reasonable security measures to protect personal information from unauthorized access, disclosure, or loss.

 

14.4 Data Retention

We retain personal information for the duration of the student's enrollment and for a reasonable period thereafter for record-keeping purposes.

 

14.5 Parent Rights

Parents have the right to:

- Access their child's personal information

- Request corrections to inaccurate information

- Request deletion of information (subject to legal retention requirements)

- Withdraw consent for marketing communications

 15. GENERAL TERMS

 

15.1 Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website and communicated to enrolled students' parents via email. Continued participation after changes indicates acceptance of modified terms.

 

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

15.3 Entire Agreement

These Terms constitute the entire agreement between parents and PeakLight Chronicles regarding photography lessons and supersede any prior agreements or understandings.

 

15.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

 

15.5 Assignment

Parents may not transfer or assign their lesson package to another party without our written consent. We may assign our rights and obligations under these Terms to another entity.

 

15.6 Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the Hong Kong courts.
